Michael E. Shaheen Jr., the counsel and lawyer-in-chief of the Justice Department's Office of Professional Responsibility since its inception in 1975, recently told a roomful of chief assistant U.S. attorneys:

There is no other department [of government] that is viewed with comparable terror or fear, because there is no other department that by itself can put you in jail or take your life, liberty or property away from you. The [Justice] Department has the FBI and the other agencies. It has become a Leviathan in the minds of a lot of people because it is so big and imponderable. I think it is correct to say that no outsider is capable of oversight.
But, a long-awaited and important piece of legislation known as the Hyde Amendment, worked into this year's final appropriations bill for the Department of Justice, allows reimbursement of legal fees to defendants who were the victims of wrongful federal prosecutions. The law, applicable to criminal cases pending on or after November 26, 1997, permits a court to award attorneys' fees and other litigation expenses to the "prevailing party" in a criminal case if it finds that "the position of the United States was vexatious, frivolous, or in bad faith," unless such an award would be "unjust." This legislation may go a long way toward providing judicial oversight of DOJ's excesses.

Wounded Angel

The Constitutional rights and liberties, framed by the wisdom of our forefathers, stands as a guardian angel of the people. The Constitution is like the Angel with a flaming sword at Eden designed to protect us from the entrance of oppressive government. Those rights and freedoms guarded by our Constitution are daily put to the test. And our guardian Angel wounded and under attack is in danger of defeat from the indifference of the people. A survey of current Court cases will reveal an ongoing neglect of Constitutional principles. A survey of the abuses of our current government will show our current danger.

In the book "The Trial" written by Franz Kafka an ambitious, worldly young bank official named Joseph K. is arrested by two warders "one fine morning," although he has done nothing wrong. K. is indignant and outraged. The morning happens to be that of his thirtieth birthday. One year later, on the morning of his thirty-first birthday, two warders again come for K. They take him to a quarry outside of town and kill him in the name of the Law.

It is a statement on how in a seemingly normal society, which is not or does not appear outwardly oppressive, an individual can be conspired against convicted, and ruined - all under the pretext of a concept of a "law", even when this individual is innocent.

CAN THIS HAPPEN IN OUR NATION? IN A COUNTRY FOUNDED ON FREEDOM AND JUSTICE?

Deaf Ears and Blind Eyes

Recently there was a great tragedy on St. George Island. It made National News. The harsh reality was that the life of a six year old child was taken away from this earth. In the space of a few minutes a community was filled with wonder how such a thing could happen. Lives were touched and for a time the whole view of life changed. How could such a thing happen?
Have you ever cried out for help? Have you ever needed someone to listen? So many things happen because we choose not to look and listen. Even if we do look and listen too often we refuse to act on what we know. We wash our hands and declare it was not our responsibility. Perhaps we settle it in our minds that we could have done nothing or that it was some strange destiny. We all have such justifications especially when the pain and tragedy is not our own.
It is a new year and resolutions have been made. In the face of a world where injustice happens it would be profitable for everyone to resolve to listen, look, and act when necessary to help others. Those things which touch others do in so many ways touch us all. We can not truthfully say any of it is not our problem.
To that end I present you the condensed story of one person's troubles. You can either listen or turn away. But if it were you and your troubles: Would you want to be heard?

Governor Crist,
I would like to put before you and your staff my story of life in North Florida. I and my wife Edda came here in 1974 from Arizona and purchased waterfront property in Eastpoint. Until this date we have developed a business known as Sportsman's Lodge. The Lodge is 11 acres of prime commercial property. As with any business we have had our ups and downs. We have had to rebuild our business 3 times after hurricane events. We have weathered these storms.
At the age of 70 after the Hurricane Dennis event many offers were made for our property. Offers as large as 25 million dollars. Being a lifelong supporter of the Seafood Workers I knew if a condominium development came in it would deny the Seafood Workers access to the ramp at Indian Creek which Sea food Workers have used since the early 1900's. I determined I could not deny them this access. So through Trust for Public Lands and Florida Forever I sold my property on the South side to the State of Florida. It was my wish that all Franklin County enjoy that unique property that has been our paradise for 34 years.
Unfortunately, since that time there has been great trouble in Paradise. The Department of Environmental Protection required me before the sale of that property to redo my whole septic system. This was done under and approved by a Court Order and inspected by Eastpoint Water and Sewer. DEP approved the engineering and held 200,000 in cash with Wakulla Bank in Crawfordville. DEP and EWSD inspected and approved both the Restaurant and Motel. Also we had to pay 105,000 to Eastpoint Water and Sewer just for the Restaurant permit to use water and sewer. This was demanded to be paid on an already permitted building or the sale would not be approved. Now DEP wants me to tear down the Restaurant at our expense because they say it is over State waters without permit. Additionally we donated 400,000 back to the State and County for maintenance of the property and paid in excess of 1 M in taxes. Yet DEP contends I cheated them out of 500.00 by not getting their permit. After the closing I paid off all mortgages on my property. The point being there was little left in the end.
Since that time various lawsuits have been filed against me by persons believing I had millions. One such case took place on December 7, 2009 in US District Court. A merit less case dismissed by local law enforcement and dismissed by the Equal Opportunity Employment Commission. This case was only motivated by the end of getting a cash settlement and not by facts. The oddity of this case was that I was not named as defendant nor was I asked to defend myself in this case. I was subpoenaed as a witness December 7th. I was asked 3 questions and dismissed. To my amazement and disgust two days later the local newspaper the “Chronicle” printed a story on the trial. The headline read “ Jurors Unanimous, Allen Liable.” The article stated that there was a 208,000 dollar judgment against me. As if that was not enough it recounted testimony where I was called a child molester and even a murderer.
It is my belief the US District Court and lawyer Marie Mattox are fully liable that this defamatory and libelous testimony was picked up by the media. But since the judgment was not against me but against the LLC. of someone I was renting a building to. I have no recourse. Lawyers and DEP has effectually broke both my spirit and bank account.
DEP filed a Notice of Violation against my restaurant building in July of 2009. We fully co-operated with them and attended the mediation in October of 2009. We have asked further mediation and specifics of what we can do. DEP has since that time been unresponsive to our request. Again, prompted by the Apalachicola River keepers another article came out in the newspaper saying DEP had a 2.4 million judgment against me. It was my understanding that DEP had set a Final Hearing for January 29th 2010.
Though this is only a general sketch of the troubles that have come on myself and my family at this Christmas season hopefully it is enough you can understand how devastating this has been. At this point I can not afford lawyers or move to my own defense. In one of the worse economies since 1929 we are struggling just to hold on to our business. The added weight of false lawsuits and the DEP seems to be determined to deprive me of what is left of my land and business.
Governor Crist, I appeal to you and your staff to investigate what has and is being done to myself and my family. I can only believe that there is and has been unscrupulous people pushing these things to ruin my business and to deprive me of my property and rights. As the head of this State you need to know such things can be done to a citizen of this great State. I am 72 years old and an honorably discharged USMC veteran of the Korean War. I am a supporter of our State and of the United States.
We have proofs and evidences available to show that I was allowed by Court and Lawyers to be defamed and slandered which led to a libelous newspaper article. We have proofs and evidences that we have co-operated with DEP but given no option except hiring an engineer. After paying lawyers there is no money to hire an engineer. We will be glad to provide any information or answer any questions. At the very least we ask you to look into these matters and judge for yourself whether the State and Courts should be allowed to ruin a man's business, family relations,finances, and personal reputation.

Preamble to Constitution

IN CONGRESS, JULY 4, 1776

The unanimous Declaration of the thirteen united States of America
when in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. A Long Train

I will not apologize for being a Southerner anymore than any person of varied origin, skin color, or sex can apologise for that heritage with which they were born. I fully understand the implications of the history of racial bias and common undertones of the words, "Southern Justice." But is it reasonable to ask of me to forego the history and heritage of my birth and experience because of a past I inherited. We should all be equally protected to own our heritage and it's history. Should all German Americans disown Germany because of Hitler? Should Italian Americans never mention their heritage because of Mussolini? We are a varied and colorful culture. We need not rewrite history for the sake of pluralism. African Americans in this country by Constitutional means defend their rights to be here and to be free. They have and will using Constitutional means preserve their heritage and history.
There is no person without a certain bias or preference. The Constitution of the United States provides for a varied and diverse culture and gives rights to all who find shelter under the wings of America. Whatever your heritage or nationality when those rights are derailed and injustice occurs there should be by the laws of this country clear recourse. The principles of the Constitution and of the Declaration of Independence are given to all Americans as safeguards of justice and liberty regardless of origin.
Perhaps if you can not get past the fact I am a Southerner who believes in justice and liberty for all, you may need to examine your own values. If you would deny me the right of my heritage and history you are possibly part of the problem. Prejudice and racism abounds in this country against many. We have been reduced to a certain depotism by our government use of divide and conquer. The message is unity but the actions are too often the bias of personal interest. We must become individuals who form a more perfect union and support those things which guarantee every persons life, liberty, and pursuit of happiness. The train of justice and freedom has been derailed by abuses and usurpations. It is time to expose the train wreckers and get back on track.

Have you read the story of the "Walrus and Carpenter" in Alice in Wonderland? Everyone should read it just so often to remind them about the details of justice,. injustice, and freedom.
I will refrain from indepth comment and reprint that wonderful story here. I will hope that you see in the Carpenter and Walrus the builders of the system and the political body that leads the people with promises only to fill their own bellies. One day we will realize we feed the system so it can feed on us. We are not so innocent as to believe the system is fully organized for our good only. Our freedom has been bought by men who shed blood to guard our freedom. It is not won by those who blindly follow the promise of peace and prosperity.

The sun was shining on the sea,
Shining with all his might:
He did his very best to make
The billows smooth and bright --
And this was odd, because it was
